While you may be covered under an employer’s policy, it does not protect you from personal risk. You may still be liable for your own negligence, and as a result, all or part of a plaintiff’s award or settlement. It’s possible you may even be required to reimburse your employer for damages paid to a claimant. You can either assume this risk or buy insurance that transfers the risk. The only way to ensure that you’re covered for your professional acts is to have your own Professional Liability policy, issued in your name. Your policy will provide you with limits of liability of your choosing. And, because the policy is issued in your name, many potential conflicts of interest between you and your employer may be eliminated in the event a claim against you is filed.

Nurses have the option of selecting claims-made or occurrence. If your policy provides claims-made coverage for the professional services you provide to your patients, it provides coverage for incidents that occur on or after your policy’s Retroactive Date (usually the date your uninterrupted claims-made coverage originally began). You may report claims involving professional services you performed in previous years, as far back as this policy’s Retroactive Date, as long as there was no interruption in your coverage from that date forward.
The limit of liability on an insurance policy is the maximum dollar amount that the insurance company will pay if a claim is filed against you.
The limit of liability that you choose should correspond to the size and scope of your practice as well as the dollar amount you believe would cover a claim that could be made against you. You should include the expense of defense costs and settlements in your decision. Because it is difficult to accurately estimate the maximum possible loss liability, professionals and organizations generally choose the highest limits of liability available to them.
Limits for this Professional Liability policy range from $250,000/$500,000 (limit per claim/annual aggregate limit) to $2,000,000/$4,000,000.
The limit per claim is the maximum dollar amount for damages and expenses that arise from claim.
The annual aggregate limit is the maximum total dollar amount that your policy will pay in your defense, per year.
As your professional skills grow and change—for example, you achieve a new level of education or expand your services—you should re-evaluate the limit of liability you carry. With claims-made coverage, you can increase your coverage limits each policy year. Whatever limit you select at the start of each coverage period will apply to any covered claim that may be reported during the coverage period, regardless of the date of the incident.
